Apple approves ‘Epic Games’ store app after initial disputes

Apple has approved the Epic Games Store app for iPhones and iPads in the EU, as reported by Reuters. This approval comes after several rejections. Apple clarified that the issue was with the Epic Sweden AB Marketplace and not the already approved Fortnite app.

Epic’s Complaints and Apple’s Rejections

Before Apple’s approval, Epic Games voiced frustration on X (formerly Twitter) about Apple rejecting its app twice. Apple had concerns that the Epic Games Store looked too similar to the App Store, particularly in button designs and labels.

Epic argued that its use of terms like “Install” and “In-app purchases” is standard across other platforms’ app stores. It stated that its goal is to create a user-friendly store for mobile users. It emphasized that disclosing in-app purchases is a regulatory best practice.

Epic accused Apple’s rejections of being arbitrary and in violation of the Digital Markets Act (DMA). They have shared these concerns with the European Commission.

Approval with Conditions

Apple approved the Epic Sweden AB Marketplace app but noted that Epic must still make certain changes. According to Section 2.3 (G) of Apple’s developer agreement, Epic must ensure its store doesn’t resemble the App Store too closely.

While Epic mostly adhered to this rule, Apple highlighted issues with the design and copy of the download button. Apple also confirmed that Fortnite had already been approved.

Epic’s Persistence

Since 2020, Epic and Apple have been in a legal dispute over Apple’s 30% commission on in-app payments, which Epic claims violates antitrust rules. Apple’s recent changes to comply with the EU’s Digital Markets Act allow alternative app stores on iPhones but introduce a criticized “core technology fee.”

The new rules position Apple as an EU “gatekeeper,” mandating developers to pay fees for using its technology. Despite legal setbacks in the U.S., Epic persists in reaching iPhone users without paying Apple’s commissions, resulting in a temporary account termination in the EU.

Regulatory intervention followed, enabling Epic Games to prepare for the launch of Fortnite and its Games Store on the iOS platform.

Launch date

Epic reiterated their readiness to launch the Epic Games Store and Fortnite on iOS in the EU within the next couple of months.
