This FoneArena Truecaller Assistant Giveaway (“Activity”) is made available by FoneArena India Pvt Ltd (“FoneArena”). Please read these terms and conditions (“T&Cs”) before participating in the Activity. By proceeding with participation in the Activity, each participant (“You”) hereby undertakes to have read and understood these T&Cs and agree to be bound by these T&Cs.

  1. Activity Period: From 20th July 2023, 06:00PM until 30th July 2023, 11:59PM.
  1. Eligibility Criteria: You need to fulfil the following eligibility criteria to participate in the Activity: (a) You should be an individual legal resident of India; (b) You should be aged 18 years or above at the time of participation in the Activity; (c) You should have a shipping address within India; (d) You should not be subject to any restriction that prevents FoneArena from offering the Activity to You, or ineligible to participate under applicable laws; (d) You should not use any unfair means to participate in the Activity; and (vi) You should fulfil and comply with all requirements set out in the T&Cs. Employees of FoneArena, Truecaller (defined below), their relatives are not eligible to participate in this Activity.

  1. Prizes: 100 Truecaller Premium Assistant Memberships, 4 Sennheiser HD 450SE Bluetooth headphones and 10 Spigen PE2007 GaN chargers
  1. Selection of Winners: A total of 114 participants will be selected as winners from amongst the eligible participants through Gleam, an online tool with built in fraud protection, on a random basis. FoneArena will announce the winners on or before 15/08/2023. Each winner will be required to claim the prize as per the requirements prescribed below in these T&Cs.
  1. Additional Terms
  • The sponsor of this Activity and the prizes provided hereunder is Truecaller International LLP (“Truecaller”).
  • Winners will be selected on a random basis from amongst eligible participants, including by utilizing automated computer program. The selection of winners, its methodology or any other aspect in any manner shall be at the sole absolute discretion of FoneArena and the decision of FoneArena will be final and binding on all participants including You. Every participant will be eligible to win a maximum of one prize.
  • Participants selected as winners will be contacted by the FoneArena team by telephone or email or in any other manner within 15 working days from the end of the Activity Period in relation to the delivery of the prizes. Each such selected participant must reply to FoneArena in writing within twenty-four (24) hours from receipt of such communication by providing their complete mailing address, phone number, email address and other relevant contact details to claim their prize, failing which such selected participant will be construed to have forfeited the prize, and will stand disqualified.
  • Prizes are non-transferable, non-negotiable, non-exchangeable, non-encashable and subject to availability. FoneArena reserves the right to substitute a given prize with any other prize, in its sole discretion.
  • Redemption and/or use of the prizes may be subject to additional terms and conditions, and participants selected as winners undertake to agree to and comply with all such terms and conditions.
  • Participants selected as winners may be subject to verification, including without limitation, verification of eligibility and compliance with these T&Cs through checks as deemed appropriate by FoneArena. FoneArena reserves the right to verify the details of the selected participants either on its own or through its authorized representative and such selected participants shall provide all necessary assistance for such verification.
  • Participants shall be solely responsible and liable for payment of all expenses, applicable taxes and/or other levy, as may be applicable, for participating in the Activity and claiming their prizes and FoneArena shall in no way be liable or responsible for the same.
  • You agree to receive communication(s) in all forms (including email, SMS, voice, etc.) from FoneArena and/or its representatives, and You unconditionally discharge (and waive all rights/claims You may have or acquire) FoneArena, its affiliates, employees, partners, representatives, consultants etc. from any and all liability or claim which You may have/acquire in relation to the Activity against either of them.
  • You give your consent to FoneArena, Truecaller and their affiliates, agents and assigns to use your name, likeness and/or image for advertising and promotional purposes in relation to the Activity, without additional consent from or compensation to you.
  • You agree and accept that your personal data, such as name, phone number, email address, address etc., may be collected, processed, shared or otherwise used for the purposes of the Activity. Such data may also be used (and reasonably retained) by FoneArena in order to verify Your identity or to otherwise verify Your eligibility to participate in the Activity.
  • You hereby acknowledge and accept the scheme and modalities of the Activity in its entirety, including the absolute sole discretion of FoneArena to conceptualize, determine, implement or vary the eligibility, methodology, implementation, selection, determination or any aspect in any manner, of the Activity.
  • The Activity is being made available purely on a “best effort” basis and participation in this Activity is voluntary.
  • FoneArena will not be responsible or liable for: (a) any failure to receive submission(s) due to transmission failure(s) or due to other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or entries or prizes; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damage caused by event(s) beyond control of FoneArena; (e) any printing or typographical error(s) in any prize associated with the Activity; or (f) any malfunctioning, merchantability, defective or damaged prize received by winners.
  • FoneArena reserves the absolute right, at any time, without prior notice and without assigning any reason whatsoever, to amend or vary these T&Cs or to replace, wholly or in part, this Activity by another activity, whether similar to this Activity or not, or to extend, or withdraw it altogether.
  • Decision of FoneArena in relation to the Activity and all matters connected or incidental thereto shall be final and binding on You. Dispute or grievance, if any, in relation to the Activity should be emailed to FoneArena at: info@fonearena.com
  • Under any circumstance, FoneArena shall not be liable for any special, indirect, incidental, punitive or consequential damages, or for lost business, lost data or lost profits / opportunity etc., arising out of or in connection with these T&Cs. Further, notwithstanding anything contained otherwise, under any circumstance the aggregate maximum liability of FoneArena to You in relation to or arising out of these T&Cs shall not exceed INR 1000 (Indian Rupees One Thousand only).
  • These T&Cs shall be governed and construed in accordance with the laws of India and any dispute arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts at New Delhi, India.
  • No failure or delay on the part of FoneArena relating to the exercise of any right, power, privilege or remedy provided under these T&Cs or otherwise shall operate as a waiver of such right, power, privilege or remedy or as a waiver of any preceding or succeeding breach by You nor shall any single or partial exercise of any right, power, privilege or remedy preclude any other or further exercise of such or any other right, power, privilege or remedy, all of which are several and cumulative and are not exclusive of each other or of any other rights or remedies otherwise available to FoneArena at law, equity or otherwise.
  • These T&Cs constitute the entire agreement between You and FoneArena concerning the subject hereof; and cannot be assigned (and any attempted assignment in violation of the foregoing restriction is void). If any provision of these T&Cs is unenforceable, that provision will be modified to render it enforceable to the extent possible to effect the intention hereunder and the remaining provisions will not be affected.
  • FoneArena reserves the right of final decision on the interpretation of these T&Cs in the event of any participant finding them unclear.
